1. Acceptance of Terms

By accessing or using the Email Migration website, tools, or migration streaming endpoints, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must discontinue use of the service immediately.

2. Description of Service

Email Migration provides an automated, browser-managed socket streaming tool that copies electronic mailboxes between IMAP-compliant servers over secure TLS channels. The service is designed to preserve folder trees, flags, timestamps, and message bodies.

3. Account Ownership & Migration Authorization

You expressly represent and warrant that:

You are the rightful owner of, or possess explicit, written administrative authorization to access and migrate, every email account, domain, and server credential submitted to the platform.
You will not use the service to unlawfully intercept, access, exfiltrate, or copy unauthorized email communications or confidential third-party data.
You are solely responsible for safeguarding the credentials you enter during active migration sessions.

4. Acceptable Use & Provider Rate Limit Compliance

When initiating migrations, you agree to respect the operational policies, bandwidth restrictions, and rate limits imposed by your respective mail providers (e.g. Google Workspace IMAP sync limits, Microsoft 365 throttling thresholds).

You agree not to use the service for distributed denial-of-service (DDoS) attacks, brute-force password cracking, bulk spam distribution, or any activity that compromises the stability of mail infrastructure.

5. Pre-Migration Backups & Disclaimer of Warranties

Best Practice Notice: While Email Migration is engineered with protocol safeguards to guarantee zero data loss, email migrations inherently interact with third-party networks, DNS servers, and external hosting providers. We strongly recommend maintaining an independent backup of all critical mail archives prior to performing MX record cutovers.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HOSTKRO, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION ARISING FROM YOUR USE OF THE SERVICE.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hostkro operates, without regard to its conflict of law provisions.
